Terms and Conditions

1. Scope
These Terms and Conditions apply to orders placed by private consumers in the Lulera online shop. Deviating terms will not be accepted. Orders can be placed from Switzerland and Germany; delivery to addresses in these countries only.

2. Offer & conclusion of contract
The product presentations in the shop do not constitute a binding offer. By clicking “Buy now” you submit a binding order. The purchase contract is concluded when we send our order confirmation by e-mail.

3. Prices, taxes & shipping costs
All prices are in CHF. Lulera is currently not liable for Swiss VAT.
Delivery to Switzerland: No VAT shown at checkout; shipping costs are displayed before purchase.
Delivery to Germany (DAP): Import VAT, customs duties and any handling/service fees are not included in the price and will be collected from the recipient upon delivery; the carrier may charge additional fees.

4. Payment & retention of title
Payment methods: TWINT and credit card (Visa, Mastercard, American Express). Your card/account is charged when you place the order. Lulera may restrict payment methods depending on amount/credit check.
Goods remain our property until paid in full.

5. Delivery, partial delivery & transfer of risk
Delivery to Switzerland and Germany.
Switzerland: usually 1–3 business days from dispatch.
Germany: usually 3–7 business days from dispatch (depending on customs clearance).
You will receive tracking by e-mail. Partial deliveries are possible (at no extra cost). Delays caused by customs are beyond our control.
For consumers, risk passes to you upon handover of the goods.

6. Right of withdrawal / returns

6.1 Germany (statutory right of withdrawal)
You have a statutory right of withdrawal of 14 days from receipt of the goods. Details are set out in the Instructions on the Right of Withdrawal for Germany (see annex).
Refund after withdrawal: We will refund all payments including the cost of the least expensive type of standard delivery offered by us without undue delay and at the latest within 14 days from receipt of your withdrawal notice. Additional costs for a delivery method you chose that differs from our standard delivery (e.g. express) are not refunded.
Partial returns: If you withdraw only part of the delivery, there is no entitlement to a refund of the original outbound shipping costs.
You bear the direct cost of returning the goods. We may withhold the refund until we have received the goods back or you have provided proof of return, whichever is earlier.

6.2 Switzerland (voluntary returns policy)
You may return unused, undamaged goods within 14 days in their original packaging. We will refund the purchase price after receipt of the return. Shipping costs (outbound and return) are not refunded; you bear the return postage.
In cases of defective goods or incorrect delivery, we cover the return postage and refund all payments.

6.3 Transport damage / incorrect deliveries
Please report transport damage or incorrect deliveries within 48 hours with photos (product, outer packaging, shipping label) so we can arrange a prompt replacement or refund. This notice is not a prerequisite for your statutory rights.

6.4 Exceptions
Customized special orders are excluded from withdrawal/returns where legally permissible.

7. Products & use
Artificial flowers are intended primarily for indoor use. Slight variations in color/size compared to on-screen images are possible. Stems are bendable and trimmable (please use wire cutters).

8. Warranty
Statutory defect rights apply. Excluded are normal wear and tear, improper handling, and damage caused by weathering/continuous UV exposure. Your statutory rights remain unaffected.

9. Vouchers & promotions
Unless stated otherwise, vouchers cannot be combined and are not redeemable for cash; any minimum order values apply as stated on the voucher.

10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under product liability laws.
In cases of slight negligence, we are liable only for breach of essential contractual obligations (cardinal duties) and limited to foreseeable, typical damages. Mandatory law remains unaffected.

11. Data protection
Personal data is collected and processed in accordance with our Privacy Policy (Swiss DSG); for customers in Germany additionally pursuant to the GDPR. There you will find information on the controller, legal bases, storage periods, data subject rights, and cookies.
Note: The Privacy Policy is available at any time in the shop.

12. Applicable law & place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers resident in Germany, mandatory consumer protection provisions of their country of residence remain unaffected.
Place of jurisdiction is Schwarzenburg, where legally permissible.

13. Online dispute resolution / consumer arbitration (DE)
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Severability clause
If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected.

Annex: Instructions on the Right of Withdrawal for Germany

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you, or a third party other than the carrier and indicated by you, take possession of the goods.

Exercising the right of withdrawal
To exercise your right of withdrawal, you must inform us (Lulera – Christian Sachs, Pöschenweg 3, 3150 Schwarzenburg, Switzerland, e-mail: support@lulera.com) of your decision to withdraw from this contract by means of a clear statement (e.g. by e-mail). To meet the deadline, it is sufficient for you to send your notice before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (except for any additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal. We will use the same means of payment you used for the original transaction unless expressly agreed otherwise; in no case will you be charged fees for such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Partial withdrawal / partial return
If you withdraw only part of your order, there is no entitlement to a refund of the outbound shipping costs.

Exclusions / expiry of the right
The right of withdrawal does not apply to customized special orders that are not pre-fabricated and for which an individual selection or determination by you is decisive.
